How the fianza works in Catalonia

When you signed your lease, your landlord collected a fianza (deposit) of one month's rent for unfurnished apartments or two months for furnished ones. By law, this money must be deposited with INCASOL (Institut Catala del Sol), the Catalan Housing Institute. It is not sitting in your landlord's personal bank account (or it should not be). When your lease ends, the landlord has 30 calendar days to return your deposit or provide a written justification for any deductions.

What your landlord can and cannot deduct

Your landlord can legally deduct for:

  • Damage beyond normal wear and tear (desgaste normal). A scratched floor from furniture is normal wear. A broken window is not.
  • Unpaid rent or utility bills.
  • Cleaning costs if the apartment is returned in a significantly dirtier condition than when you moved in.

Your landlord cannot deduct for:

  • Normal wear and tear: faded paint, minor scuffs, worn carpet, slightly yellowed grout. These are expected after a tenant has lived in the apartment.
  • Pre-existing damage that was already present when you moved in (this is where your move-in photos and inventory are crucial).
  • Improvements or upgrades they want to make for the next tenant.

What happens if they do not return it

If your landlord does not return your deposit within 30 days and does not provide written justification for deductions, they owe you the full amount plus legal interest. You can file a claim through the Catalan Consumer Agency (Agencia Catalana del Consum) or take it to the Juzgado de Primera Instancia (First Instance Court). VAT included in all prices. Move-out cleans tend to cost slightly more than move-in cleans because the apartment has been lived in and appliances require deeper treatment. What can increase the price

  • Heavy grease or limescale: If the oven has never been cleaned or the bathroom has significant limescale buildup, extra treatment time is needed.

End-of-tenancy checklist for expats leaving Barcelona

Leaving a Barcelona apartment involves more than just cleaning. Here is a practical checklist to make sure you do not miss anything:

Before the cleaning

  • Remove all personal belongings. Check inside wardrobes, storage rooms (trastero), and the balcony. Landlords can charge for removing items you leave behind.
  • Check your original inventory. Compare the current state of furniture and appliances against the inventory list (inventario) you signed at move-in. Report any pre-existing damage that you documented when you arrived.
  • Fix minor damages if possible. Filling small nail holes in walls with filler (masilla) costs a few euros and prevents a much larger deduction. You can buy it at any ferreteria (hardware store) or Leroy Merlin.
  • Gather all keys. Building entrance, apartment door, mailbox, storage room, garage. Landlords charge 50-150 euros to replace lost keys, especially if the building entrance lock needs changing.

Utilities and admin

  • Request final utility readings. Contact Aigues de Barcelona (water), your electricity provider, and your gas provider to schedule final meter readings or provide self-readings.
  • Cancel your internet. Spanish telecom contracts often have minimum terms. Check if you need to give 30 days' notice (most providers: Movistar, Vodafone, Orange, MasMovil).
  • Redirect mail. Correos (Spanish post) offers mail forwarding for a fee. If you have important documents still arriving at your Barcelona address, set this up 2-3 weeks before leaving.
